The Party Wall etc Act 1996

The Party Wall etc. Act 1996 took effect in England and Wales from the 1 July 1997. It was introduced to provide a framework for preventing and resolving disputes.

If it is intended to carry out any building work which involves:-

Work on an existing wall shared with another property, Building on the boundary with a neighbouring property or Excavating near a neighbouring building.

The person or persons commissioning such work (the Building Owner) must give advance notice to the neighbours (the Adjoining Owners) before starting any work.

If a scheme includes work to a Party Wall two months notice is required. Building on the boundary and excavations require one months notice.

If the neighbour (the Adjoining Owner) objects, or does not respond, a dispute is regarded to have arisen. The person or persons commissioning the work (the Building Owner) will need to appoint a Party Wall Surveyor to resolve the dispute.

Surveyors of Solent Surveying Services are able to act in the role of "Consultants" or as the "Party Wall Surveyor" to resolve any issues raised under this legislation.
